We are investigating allegations that Capital One Bank engages in the unlawful business practice of imposing multiple Non-Sufficient Funds Fees (“NSF Fee”) and/or Overdraft Fees (“OD Fee”) on single transactions. Consumers allege the bank charges a $35 NSF Fee when it determines a customer’s account contains insufficient funds to pay a transaction. The bank then allegedly retries the transaction, without consumer knowledge or instigation, and the same transaction may then incur an additional NSF fee. The bank may also advance the funds and pay the transaction anyway, allegedly causing the consumer to incur an additional $35 overdraft fee.
Capital One Bank may profit hundreds of millions of dollars annually often at the expense of its most vulnerable customers using said business practices.
