We are investigating allegations against a variety of snack food companies that may be using packaging to mislead consumers into thinking that the boxes are completely filled. Slack Fill is the difference between the actual capacity of a container and the volume of product contained therein. Packaging may be in violation of the FDA rule that “A container that does not allow the consumer to fully view its contents shall be considered to be filled as misleading if it contains nonfunctional slack-fill.”
